This is an English translation of our Thai terms of use, provided for your convenience. If the two differ, the Thai version prevails.
These terms set the conditions for using www.kintury.com and kinturyenergy.com ("the website") of Kintury Energy Company Limited (บริษัท คินทูรี่ เอ็นเนอร์ยี่ จำกัด) ("the Company" or "we"). Please read them before you use the website. How we collect, use and disclose personal data is set out in our privacy policy, which forms part of these terms.
1. Acceptance
- By visiting or using the website, sending a form or applying for a programme through it, you confirm that you have read, understood and agree to these terms, including the use of cookies in section 8. If you do not agree, please stop using the website. You may decline statistics cookies as described in section 8.6 and still use the website as normal.
- If you use the website or send information on behalf of a company, an organisation or another person, you confirm that you have the authority to act for them and to bind them to these terms.
- If you sign a separate contract with the Company, such as an installation contract, a power purchase agreement (PPA) or a quotation you accept, these terms apply together with that contract. Where they conflict, the contract prevails.
2. Who runs the website
The website is run by Kintury Energy Company Limited, which advises on, designs, installs and maintains solar panels, batteries and clean energy systems, and runs training courses and events that you can sign up for on the website. The Company's address is Thai Ace Building, 555 Nawamin Road, Khlong Kum, Bueng Kum, Bangkok 10240, Thailand. Contact details are in section 12.
3. Permitted use and prohibited acts
You may use the website to find information about the Company and its services, read articles, use the solar calculator, contact the Company, send an expression of interest, and apply for programmes, training courses or events, for yourself or for an organisation you are authorised to act for, in good faith and lawfully. You must not:
- use the website unlawfully or fraudulently, or in a way that infringes the rights of the Company or anyone else;
- give false information, pretend to be someone else, or send other people's personal data without the right to do so;
- send advertising or spam, or send forms repeatedly or by automated means;
- access or try to access the back office, other people's accounts or any part not open to the public, probe for vulnerabilities, or get around security measures, without the Company's written permission;
- send viruses or harmful code, or do anything that overloads the website, disrupts it or stops it from working;
- use automated tools to extract or copy content from the website in bulk for commercial use or republication without permission (general search engines may crawl the website as its robots.txt file allows);
- use the Company's name, content or marks in a way that misleads others into thinking something comes from, is endorsed by or is connected with the Company.
If you breach these terms, the Company may refuse or cancel your request or application, block your access to the website and take legal action, including under the Computer-Related Crime Act B.E. 2550 (2007), and you are liable, as the law provides, for the damage the breach causes the Company.
4. Information on the website
4.1 General information, no warranty
Articles, pictures, prices, figures for electricity savings and payback, and information about products or services on the website are general information to help you make a first assessment. They are not engineering, financial, tax or legal advice for your situation. The Company tries to keep the information accurate and up to date, but to the extent the law allows, it does not represent or warrant that the information is accurate, complete, current or suitable for your purpose, and it may change the information without notice. Before you decide to invest or sign a contract, please ask the Company for confirmed information.
4.2 The solar calculator gives estimates only
The results of the solar calculator are first estimates based on the figures you enter and general assumptions. They are not a quotation, not an offer and not a guarantee of the number of panels, system size, electricity produced, savings on your bill or payback time. Real results depend on the direction and tilt of the roof, shading, the equipment chosen, the hours you use electricity, the electricity rate and the weather. Only the prices and figures in a written quotation or contract that the Company issues after a site survey bind the Company.
4.3 Offers and promotions
Offers on the website, such as installation at no cost under a power purchase agreement (PPA), payment by instalments or a free site survey, are subject to the eligibility criteria and conditions of each offer, the Company's survey and assessment, and a written contract. The Company may change or end an offer; this does not affect contracts already signed.
4.4 Programmes, training courses and events
Details of programmes, training courses and events, such as dates, times, venues, speakers, content, fees and benefits, may change when needed. The number of seats shown on the website is correct at the time it is shown and can change at any time. The Company may postpone, change or cancel a programme, for example when too few people apply or for another necessary reason, and will tell applicants through the contact details they gave. If the Company cancels a programme you have paid for, it will refund the amount you paid; to the extent the law allows, that refund is the limit of the Company's liability in that case, unless the loss is caused by the Company's wilful misconduct or gross negligence.
4.5 Availability of the website
The Company takes reasonable care to keep the website available, but does not guarantee that it will always be available, error-free or free of viruses, and may update, suspend or close all or part of the website when needed.
5. Forms and the information you send
- The forms on the website are the form to express interest in an installation or ask for advice, applications for programmes, training courses or events (courses and events), and the status check.
- You confirm that the information you send is accurate, complete and up to date, and that you have the right to give it. If you give information about other people, you must tell them about it as the privacy policy describes and have a lawful basis to give it to the Company.
- Sending a form or an application is not a contract. Sending information, receiving a reference code or an email saying that your application was received only tells the Company what you would like. It does not create a contract or oblige the Company to accept you on a programme, provide a service or install a system until the Company confirms with you: for a programme, by confirming your place by telephone, LINE or email; for an installation or a service, by a quotation or contract both parties agree in writing.
- The Company may accept or refuse a request or an application according to eligibility, the number of seats and the conditions of the programme or service, and may cancel a confirmed place if the information given turns out to be untrue or these terms are breached.
- You may use the status check only for your own records or records you have the right to check, never to look up other people.
- A minor must have the consent of the person exercising parental power before applying or sending information.
- The Company collects, uses and discloses the personal data you send as set out in the privacy policy.
- The Company may use suggestions or comments you send about the website and its services to improve them, without payment. Any personal data in them is still handled under the privacy policy.
6. Intellectual property
- The text, articles, pictures, graphics, videos, the Company's name, logo and marks, the page design, the calculator and the website's software are the copyright or other intellectual property of the Company or of those who license them to the Company, and are protected by law.
- You may view, print or save content for your personal use or for internal, non-commercial use within your organisation, and you may share links to pages. You may not copy, adapt, publish or use content commercially without the Company's written permission, except as the law allows, such as the exceptions to copyright infringement under the Copyright Act B.E. 2537 (1994).
- These terms do not transfer or license any of the Company's intellectual property rights to you beyond what this section allows.
7. Links to other websites
The website links to websites, apps and services of others, such as LINE, Google Maps and the sources cited in articles, for your convenience. The Company does not control them and is not responsible for their content, accuracy, security or policies. A link does not mean that the Company endorses or agrees with them, and your use of them is governed by their own terms. Others may link to this website, but not in a way that suggests the Company's endorsement or connection, and not by showing the Company's pages inside a frame of another website.
9. Limitation of liability
- To the fullest extent the law allows, the Company and its directors, employees and agents are not liable for any loss or damage, direct or indirect, including loss of profit, revenue, data or business opportunity, arising from or in connection with (1) using or being unable to use the website, (2) relying on or using information on the website or the calculator's results, (3) delays, interruptions or errors of the website, systems or networks, (4) unauthorised access or acts of third parties, or (5) websites or services of others that the website links to.
- This section does not exclude or limit the Company's liability (1) for damage to life, body or health caused by an intentional or negligent act of the Company or of a person it is responsible for, (2) for damage caused by the Company's fraud, wilful misconduct or gross negligence, or (3) in any other case where the law does not allow it to be excluded or limited, and it does not take away your rights under consumer protection law.
- Liability for installation work, services or programmes under a contract with the Company is governed by that contract.
- You are liable, as the law provides, for the damage and reasonable costs the Company incurs because you breached these terms or the law, or because information you sent was incorrect or infringed the rights of others.
- If a court finds any of these terms unfair, that term applies only to the extent that is fair and reasonable in the circumstances, under the Unfair Contract Terms Act B.E. 2540 (1997).
10. Changes to these terms
The Company may change these terms from time to time, for example when the website, its services or the law change. The latest version is shown on this page with the date it takes effect. For significant changes, the Company will give reasonable notice on the website in advance. Continuing to use the website after the effective date means you accept the new version. Changes do not apply backwards to applications or requests the Company has already confirmed.
11. Governing law and disputes
- These terms are governed by and interpreted under Thai law, and disputes arising from or in connection with them or with the use of the website fall under the jurisdiction of the Thai courts. Both parties will first try to settle a dispute in good faith; you can contact the Company as in section 12.
- If any of these terms is void or unenforceable, the rest remain in force. If the Company does not exercise a right under these terms on one occasion, it does not waive that right.
- The Thai version of these terms is the original. The English and Chinese versions are translations for convenience; if they differ from the Thai version, the Thai version prevails.
